The State has been hard at work working unifying its long-term care services and supports. They believe unification is an important first step to contain costs and give Ohio citizens the support they need in the settings they desire. Over the past two years changes have been underway, in processes like PASRR and are forthcoming in processes like level of care, that will bring the State closer to their goals. Come learn what Ohio is trying to accomplish and how these changes will affect you as a long term care operator. 1. Medicare and Medicaid Integrity Programs: What to Know to be Prepared and be Successful, Part 1 - Dianne De La Mare, Senior Vice President for Regulatory Affairs, American Health Care Association and Paula G. Sanders, Esq., Post & Schell, P.C.

Most LTC providers understand that current Medicare/Medicaid cuts decrease resources necessary to improve quality of care in facilities on the front end; but on the back end, the Medicare/Medicaid Integrity Programs, with investigations/audits/penalties, also are decreasing provider resources to care for the patients/residents. To better understand these Integrity Programs, the speakers will provide a global review of the Medicare/Medicaid Integrity Programs; focus on the current Medicare/Medicaid audits (RACs/MICs); discuss enforcement and what to do when the inspector walks into the facility; and provide information on designing and implementing compliance programs, to avoid any problems with integrity.

4.What’s New, Different and on the Horizon for Labor & Employment Laws – Susan C. Rodgers, Shareholder, Amanda L. Walls, Associate, Buckingham, Doolittle & Burroughs, LLP

Although much public attention has been given to major initiatives such as the economic stimulus bill and the health care debate, employment and labor law initiatives are also priorities of this administration and the Congress. Already in effect are brand-new requirements imposed by the recently passed Genetic Information Nondiscrimination Act (GINA), as well as revised regulations regarding ADA compliance, expansion of military FMLA leaves, and an extension of the COBRA premium subsidy. Waiting in the sidelines are issues including mandatory paid sick leave as well as employees' choice of a collective bargaining representative. This session will provide an overview of what's new, what's different, and what's on the horizon for the laws governing personnel management.

As a healthcare executive, it is important to understand a number of new regulatory and legal developments and how those developments will have a direct impact on our profession and your daily operation. Topics such as Health Care Reform, new compliance requirements, legal perspectives on RAC audit preparation and appeals, tips on how to preserve and/or improve your Five Star rating, and the latest CMS and ODH survey pronouncements are some of the things to be discussed. Ms. Rolf will also report on the status of OHCA's participation as amicus in an employment case and provide a general case law update.

The session will explore operational benchmarking opportunities in the Medicaid and Medicare programs. Attendees will be able to compare both revenue and expenses to like facilities in their peer group and to facilities across the State. In addition, they will be able to look at Medicare utilization and therapy groupings to see how they stack up to others and what the RAC auditors might be looking at also.

6. Diversifying Your Long-Term Care Portfolio: Considering Supplemental Business Lines

As “long-term care” evolves, both by consumer choice and government influence, many senior housing providers are considering supplemental business lines in order to better serve their current and future customers. These alternative business lines not only allow facility-based providers to diversify their services “portfolio”, they also provide additional income opportunities to senior housing and rehabilitation providers. This session will review various methods of and barriers to entry (e.g., start-up, joint venture, acquisition) into community-based offerings, such as home health care and hospice. The speakers will also address practical operational obstacles, financing, and other issues of concern that arise when embarking on such a business expansion.

7.Ask the Lenders: Navigating the HUD LEAN Program – T. Brian Pollard, Senior Managing Director and Kassem K. Matt, Vice President, Lancaster Pollard

One year ago HUD introduced the most comprehensive overhaul of its senior living mortgage insurance programs ever, LEAN processing. Demand for the program surged with the combination of the potential for a compressed timeline to access capital and tight credit markets that curtailed traditional financing options. During this year of financial turmoil and dependency on HUD financing, much has been learned by experienced lenders and borrowers about how to most efficiently approach HUD to prepare for refinancing, acquisition, renovation or new construction under this new system.
