3. Working in Partnership: Ensuring Healthcare Regulatory Compliance in Employment Decisions

This session will focus on how licensure and certification requirements govern a long-term care facility’s hiring, training and disciplinary practices, and how these requirements interact with state and federal labor and employment laws. The speakers, who focus their respective legal practices on Healthcare Regulatory Law and Employment Law, will provide concrete examples of situations in which compliance with licensure and certification requirements mandate how certain employment matters, including hiring and employee discipline, should be administered. The speakers will also provide best practices that Administrators and Human Resource professionals can follow when implementing employee discipline following incidents affecting licensure and certification.

This session will discuss how 75% of every claim dollar is spent on conditions that are lifestyle related, and how wellness initiatives that use biometric data can mitigate chronic claims or avoid them. Attendees will learn the various types of Wellness programs available, and the differences between Participation based and Outcome based. 5. More Bang for the Buck – how to use incentive compensation to reduce fixed costs and reward your best performers

The recent recessionary environment has brought diminished operating budgets and margins and has forced businesses to adjust their fixed costs in an effort to accumulate or conserve capital. Payroll represents a significant fixed cost, yet the base salaries comprising payroll don’t necessarily motivate high performing employees to contribute at the level that businesses need to succeed. 8. Internal Investigation Principles: An Objective Approach to Finding the Facts

Human resources professionals are often called upon to recommend when, how, and indeed whether an investigation of alleged wrongdoing should be conducted. Allegations may come from diverse sources such as employees, residents or their families, governmental agencies, audits, or whistleblowers. The allegations may involve employee activities, abuse of residents, financial malfeasance, Medicare fraud, violation of equal employment laws, or sexual harassment, and may arise in the context of litigation or threatened litigation.

This session will cover principles and recommendations useful in deciding why, when, and how to conduct an internal investigation and what use should or could be made of the results of the investigation. The principles and recommendations will be applicable in a variety of situations and will constitute an approach toward discerning the facts with objectivity while developing an appropriate response to the allegations. The importance of maintaining the attorney-client privilege will also be discussed.

Mark Capuano, Huntington

Sharon Clark, Partner, Cooper & Walinski, LPAM is a partner with the law firm of Cooper & Walinski, LPA, in Toledo, Ohio and concentrates her practice in employment law and commercial transactions. Before joining the firm in 2000, Ms. Clark was a solo practitioner and previously served as in-house counsel with Honeywell International, Inc., where she focused on employment law matters along with corporate and commercial transactions. She has also served as an Adjunct Professor at the University of Michigan Ross School of Business, where she taught undergraduate and graduate employment and business law courses. She is admitted to practice in Ohio, Michigan, and the federal courts in those states. She is a litigator and handles employment law and medical malpractice nursing home defense. She has represented employers, large and small, in discrimination cases before state and federal administrative agencies and courts. Ms. Foley serves as a Mediator for the U. S. John D. Goodman, Esq. is Vice President, General Counsel & Corporate Secretary of The Schroer Group of companies which includes the Altercare nursing facility division, the Absolute Health Services family of companies, and Avalon Foodservice. John has been with The Schroer Group since 2002. John handles a wide variety of legal issues in this capacity including: corporate law, contract drafting and review, health care law issues, risk management, corporate compliance, employment and labor law issues, transactional work, litigation management, and he works closely with the organization’s outside legal advisors. John received his bachelor degree in 1996 from the University of Michigan and his law degree from the Cleveland-Marshall College of Law in 1999. Craig T. Haran is a Partner with the law firm of Frantz Ward LLP in Cleveland. He focuses his practice in all aspects of Healthcare Law and Long-Term Care. He routinely counsels clients in transactional matters, regulatory and operational matters, survey and certification, Medicare and Medicaid enrollment, reimbursement and compliance matters. Stephanie Kessler is a manager with the Strategy and Human Capital practice at RSM McGladrey. In her more than ten years of consulting experience, Stephanie has worked with Healthcare, Manufacturing, Higher Education, Banking and Non-Profit Organizations. The primary focus of these services has been to value work, design compensation programs, and project the human resource investment required to implement these programs. Susan Marsico, LNHA, Director of Training, HCF Management, Inc. has over twenty five years of experience in long term healthcare. She has been a licensed nursing home Administrator for 22 years and has extensive experience in the areas of Person Centered Care, leadership, employee development, customer service, public relations, and quality of life issues. She has had consulting relationships, and provided training programs for colleges, industry and healthcare organizations. Susan is the Director of Training for HCF Management, Inc. Charles Okorowski is the Vice President - Human Resources for HCF Management, Inc. As Vice President - Human Resources, Charles is responsible for the design of formal systems at HCF that ensure the effective and efficient use of human talent to accomplish organizational goals. Additional responsibilities include strategic management, workforce planning and employment, human resource development, compensation and benefits, employee relations, occupational health, safety and security. Charles is a member of the Ohio Health Care Association (OHCA) and has actively participated on the convention task force for over twelve years. Additionally, Charles has been an active member of the human resource committee for twelve years and was elected to chair the OHCA Human Resource Committee in 2005. Rob Pivonka, Partner, Rolf & Goffman (an OHCA Platinum Champion Partner) is a partner with Rolf & Goffman, the Ohio Health Care Association’s legal counsel. His practice is concentrated on the defense and representation of employers. He assists health care providers with their human resource, labor and employment issues, such as hiring, firing, discrimination, organizing and wage and hour issues. He is experienced not only in the development of operational policies and protocols for proactively protecting long-term care providers, but also in defending facilities against administrative actions and lawsuits.

Doug Short, President, Benicomp graduated from Manchester College in 1980 with a double major in Business Administration and Computer Programming. Cindy relies on her 15 years of human resources experience and over 13 years of legal experience to create practical, customized approaches to labor and employment issues in long-term care. In addition to representing long-term care employers before the EEOC, state civil rights agencies, and state and federal courts, Cindy assists employers in disciplinary action counseling, supervisory training, employment policy drafting and implementation, wage and hour issues, and union avoidance. Steve Sullivan is a Director with Human Capital Practice. Prior to joining RSM McGladrey, Steve was a Senior Manager with Ernst & Young LLP. Steve has conducted research and has spoken in the area of Institutional Investor Activism. Steve is a member of the National Association of Stock Plan Professionals, the Society of Human Resource Management and World At Work. Steve received a Bachelor's degree from Gustavus Adolphus College, a Master’s Degree from California State University, and is ABD in the Industrial/Organizational Psychology Ph.D. program at Illinois Institute of Technology.

Marijane E. Treacy, Esquire, Partner, Schutjer Bogar LLC (an OHCA Gold Champion Partner) is part of the firm’s Medicaid eligibility, and labor and employment practice groups. She handles numerous Medicaid eligibility matters and appeals, and secures guardianship appointments for incapacitated residents. In addition, she provides daily counsel to long-term care clients throughout Ohio and Pennsylvania on general Medicaid eligibility issues and policies. Ms. Treacy also practices labor and employment law on behalf of the firm’s clients. Prior to joining Schutjer Bogar LLC, Ms. Treacy exclusively represented management clients for a national labor and employment law firm. Ms. Treacy trains the firm’s clients, as well as professional organizations, on Medicaid eligibility, EEO, anti-harassment, union avoidance, supervisory skills, recruitment and retention, and limiting litigation and disputes.
